We collect, store, access, and process ("use") only the data we need operate our service. When we use User Content generated or collected on our app, we do so only in aggregate and/or de-identified form. We use User Content to improve our service. We don't sell your Personal Information (name, email, etc.) to third parties.

When we access your data

Except when required by law, to defend our rights, to operate our service, or for a narrow set of business purposes, we don't access your name, email, or other Personal Information. Similarly, only after we have reasonably de-identified User Content do we use it to improve our services.

Security

We take reasonable measures to protect your data from unauthorized access or disclosure, including encryption and access controls. We use third-party services to store and process your data, and we take care to choose reputable providers. However, no system is perfect, and we cannot guarantee the security of your data. Take care not to disclose confidential information.

Parents

We do not knowingly collect Personal Information from children under the age of 13. If you have reason to believe that a child under the age of 13 has provided Personal Information to us, please email us at moshi.dsar@gmail.com.

By using the Service, you are agreeing to this policy.

If you do not agree with our policies and practices, your choice is not to use the App. This policy may change from time to time. Your continued use of the App after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.

We collect Personal Information using the following methods:

  1. Account information

    When you create an account, we collect your email address and password. We use this information to authenticate you when you log in.

  2. User content

    When you use the App, we collect the content you create. This includes audio recordings and the text transcripts of those recordings. We use this information to provide the main functionality of our application, which is exchanging spoken language.

  3. Communications with us

    When you communicate with us (via email, phone, through the App, or otherwise), we store a copy of your communications. We use this information to respond to you and to improve our service.

  1. Usage data

    When you use the Service, we collect information about your usage of the Service. This includes the time, frequency, and duration of your recorded utterances; the details of your connection; the features you use; and the actions you take.

  2. Log data

    When you connect to this website or our App, we store information about your connection in server logs. This includes details of your connection, including IP address, browser type, device type, operating system, country, time zone, and how you interact with the service.

  3. Cookies

    We don't use cookies on this website.

2. How we use your information

We may use your information for the following purposes:

  • To provide, administer, maintain and/or analyze the service;
  • To improve the service and conduct research;
  • To communicate with you;
  • To develop new programs and services;
  • To prevent fraud, misuse, criminal activity, harassment, bigotry, misinformation, and to protect the security of our systems;
  • To comply with legal obligations and legal processes and to protect our rights, privacy, safety, property, and/or that of our affiliates, you, or other third parties.

Aggregated or De-Identified information.

We may aggregate or de-identify Personal Information. Aggregated and/or de-identified information is not considered Personal Information for purposes of this Privacy Policy, and we may use and disclose it for any purpose. We will maintain de-identified information in a manner that does not allow it to be linked to an individual, and will not attempt to re-identify such information, unless required by law.
Please note that we may use, disclose, and otherwise process De-Identified Information for any purpose, and it is not subject to the restrictions in this Privacy Policy. To the extent that we combine De-Identified Information with Personal Information, we will treat the combined information as Personal Information under this Privacy Policy.

3. Disclosure of personal information

In some circumstances, we may provide your Personal Information to third parties without notice to you, unless required by law:

Vendors and Service Providers: To operate the service and meet business operation needs, we may provide Personal Information to vendors and service providers including cloud services, email services, and others. These third parties, to fulfill our instructions, will access, process, or store Personal Information only within the scope of performing their duties to us.

Business Transfers: If we go through a reorganization, bankruptcy, or other transition of service, your Personal Information and other information may be disclosed in the diligence process with counterparties and others assisting in the process. This information will be transferred to a successor or affiliate as part of a change of ownership or other reorganization.

5.b Verification.

To protect your privacy, we will take steps to verify your identity before fulfilling your request. If you have an account with us, we may verify your identity by requiring you to sign in to your account. If you do not have an account with us, or if we suspect fraudulent or malicious activity, we may ask you to provide additional information to verify your identity. We will only use this additional information to verify your identity. We will delete this additional information after we fulfill your request, except as required by law.

5.c Authorized Agents.

You may also submit a rights request through an authorized agent. If you do so, the agent must present signed written permission to act on your behalf and you may also be required to independently verify your identity and submit proof of your residency with us. 5.d Appeals.

Depending on where you live, you may have the right to appeal a decision we make relating to requests to exercise your rights under applicable local law. To appeal a decision, please send your request to moshi.dsar@gmail.com.

6. Children

Our Service is not directed at children under the age of 13. ChatMoshi does not knowingly collect Personal Information from children under the age of 13. If you have reason to believe that a child under the age of 13 has provided Personal Information to us, please email us at moshi.dsar@gmail.com. We will investigate any notification and if appropriate, delete the Personal Information from our systems. If you are 13 or older, but under 18, you must have consent from your parent or guardian to use our Services.

7. Links to other websites

The Service may contain links to other websites not operated or controlled by ChatMoshi (“Third Party Sites”). The information you share with Third Party Sites will be governed by their policies, not ours. By providing these links we do not imply that we endorse or have reviewed these sites or their policies. Most sites have their own Privacy and other Policies freely available, and we encourage you to review those before interacting with any of the Third Party Sites.

8. Security and Retention

We implement commercially reasonable measures to protect Personal Information both online and offline from unauthorized access, disclosure, or alteration. However, no Internet transmission is ever completely secure or free from errors. You should be judicious about what information you send to us via the Service or email. In addition, we are not responsible for circumvention of any privacy settings or security measures contained on the Service, or third-party websites.

We retain your Personal Information for only as long as we need in order to provide our Service to you, or for other legitimate business purposes such as resolving disputes, safety and security reasons, or complying with our legal obligations. How long we retain Personal Information will depend on a number of factors, such as the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure, our purpose for processing the information, and any legal requirements.

9. International users

All data is currently stored, processed, and accessed in the US.

9.a Europe

We do not have a Data Protection Officer ('DPO') registered in the European Economic Area (EEA). If you are located in the EEA, please do not use the App.

9.b Outside Europe

If you are located outside of the EEA, you consent to the processing and transfer of your Personal Information in and to the U.S. and other countries. The laws in the U.S. and these countries regarding Personal Information may be different than the laws of your state or country.
